Website Terms of Service (B2C + Trade)
These Website Terms of Service (the “Terms”) apply to your use of parkscandleslondon.com (the “Website”) and to any orders you place with us through the Website.
Some sections apply to all customers, and some apply only to Consumers (B2C) or Trade Customers (B2B). Where there is a conflict, the relevant section for your customer type will apply.
1) About us
Parks Candles London (referred to as “we”, “us”, “our”) supplies home fragrance products.
2) Definitions
· Consumer / B2C: An individual buying products wholly or mainly for personal use.
· Trade Customer / B2B: A business buying products for purposes relating to its trade, business, craft, or profession.
· Products: Items offered for sale on the Website.
· Order: Your request to purchase Products via the Website.
3) Using the Website
· You must provide accurate information when creating an account or placing an order.
· You are responsible for maintaining the confidentiality of any account login details.
· We may suspend access to the Website or close accounts where we reasonably believe there has been misuse, fraud, or breach of these Terms.
4) Product information
· Product images are for illustrative purposes. Colours, finishes, and packaging may vary slightly.
· Product descriptions, specifications, and availability may change from time to time.
· We may discontinue Products or amend ranges.
5) Pricing, promotions and VAT
· Prices and promotions are shown on the Website and may change.
· VAT will be applied where required and shown at checkout.
· Delivery charges (if applicable) will be shown at checkout.
· If a pricing error is obvious and unmistakable, we may correct it. If this affects your Order, we will contact you and you may cancel.
6) Placing an order and acceptance
· An Order is an offer by you to purchase Products.
· Your Order is accepted when we send an order confirmation or dispatch confirmation (whichever occurs first).
· We may refuse or cancel Orders (in whole or part) where we reasonably believe:
o Products are unavailable,
o there has been a pricing/listing error,
o payment cannot be authorised,
o the Order appears fraudulent or in breach of these Terms.
7) Payment
· Payment methods available will be shown at checkout.
· Unless we have agreed credit terms in writing (Trade Customers only), payment is due at the time of Order.
8) Delivery
· Delivery options, costs, and estimated timescales will be shown at checkout.
· Delivery dates are estimates and not guaranteed.
· You must inspect deliveries promptly.
8A) Risk (who is responsible if something happens in transit)
· Consumers (B2C): Risk passes to you when you (or someone you nominate) takes physical possession of the Products.
· Trade Customers (B2B): Risk passes to you on delivery to the address you provide.
9) Returns, refunds and cancellations
Returns and refunds differ depending on whether you are a Consumer (B2C) or a Trade Customer (B2B).
9A) Consumers (B2C) – cancellation rights (change of mind)
If you are a Consumer, you usually have the right to cancel your Order within 14 days of receiving your Products (the “cooling-off period”), without giving a reason.
Important exceptions: The cooling-off right may not apply to certain items, including goods that are sealed for hygiene reasons where the seal has been broken, or items made to your specifications.
If you cancel: - You must return the Products to us. - Products must be unused and in their original packaging where possible. - We will refund the price paid for the Products and the standard delivery cost (if applicable), in line with consumer law. - You are responsible for return postage unless we agree otherwise.
9B) Consumers (B2C) – faulty or not as described
If Products are faulty, damaged, or not as described, you may be entitled to a repair, replacement, or refund under the Consumer Rights Act 2015.
9C) Trade Customers (B2B) – returns policy
Trade orders are supplied for business use. Unless we agree otherwise in writing, we accept returns only for: - Damaged in transit (notify us within 48 hours of delivery) - Incorrect items supplied (notify us within 5 working days of delivery) - Faulty products (manufacturing defect) (notify us within 30 days of delivery or as soon as discovered)
We do not accept Trade returns for change of mind, overstocking, or fragrance preference.
9D) Evidence and process (all customers)
To help us resolve issues quickly, we may request: - Order number and contact details - Photos of the Products and packaging (including shipping label) - Batch/label details (where relevant)
10) Title (ownership)
· Consumers (B2C): Ownership passes to you when we receive payment in full.
· Trade Customers (B2B): Ownership passes to you when we receive payment in full, and we may withhold title where payment is outstanding.
11) Your responsibilities (storage, use and safety)
· Follow all product care and safety instructions.
· Store Products appropriately.
· Keep Products away from children and pets and never leave a burning candle unattended.
12) Intellectual property
All content on the Website (including text, images, logos, product names, and designs) is owned by or licensed to us and is protected by intellectual property laws. You may not use our brand assets without our prior written consent (except where we provide approved assets for trade partners).
13) Prohibited use
You must not: - use the Website in any way that breaches applicable law, - attempt to gain unauthorised access to the Website or our systems, - interfere with the Website’s operation (including introducing viruses or malicious code), - scrape, copy, or reproduce pricing or Website content for competitive purposes.
14) Limitation of liability
· Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law.
14A) Consumers (B2C)
Nothing in these Terms affects your statutory rights. We are responsible for foreseeable loss and damage caused by us. We are not responsible for losses where: - they were not foreseeable, or - they were caused by events outside our reasonable control, or - they were caused by misuse or failure to follow care instructions.
14B) Trade Customers (B2B)
Subject to Section 14 (first bullet), we are not liable for: - indirect or consequential losses, - loss of profit, revenue, business, goodwill, or anticipated savings.
Our total liability to you for all claims arising out of or in connection with an Order is limited to the amount paid by you for the relevant Products giving rise to the claim.
15) Force majeure
We are not responsible for delays or failure to perform caused by events outside our reasonable control (including courier disruption, supply chain issues, strikes, fire, flood, or severe weather).
16) Privacy and cookies
We process personal data in accordance with our Privacy Policy and use cookies as described in our Cookie Policy (where published on the Website).
17) Changes to these Terms
We may update these Terms from time to time. The version in force at the time you place an Order will apply to that Order.
18) Governing law and jurisdiction
These Terms are governed by the laws of England and Wales.
· Consumers (B2C): If you live in the UK, you can bring legal proceedings in the UK courts. If you live outside the UK, mandatory local consumer protections may also apply.
· Trade Customers (B2B): The courts of England and Wales have exclusive jurisdiction.
